IN THE MATTER OF THE AUTHORITY OF THE REGIONAL ELECTION DIRECTORS TO PROCURE APPLICATION FORMS FOR USE IN RESUMPTION OF THE SYSTEM OF CONTINUING REGISTRATION OF VOTERS IN NON-ARMM AREAS ON APRIL 1, 2011

WHEREAS, Resolution No. 9149, promulgated on February 22, 2011, entitled "Rules and Regulations For the Resumption of the System of Continuing Registration and Validation of Registration Records in the Non-ARRM Areas", provides that the system of continuing registration of voters for non-ARMM areas shall resume on April 1, 2011, and end on October 31, 2012;

WHEREAS, there is the need to procure application form for use in said resumption of the system of continuing registration of voters;

WHEREAS, for purposes of the registration of voters in connection with the October 25, 2010 barangay and sangguniang kabataan elections, application forms were procured at the regional level, in accordance with Minute Resolution No. 10-0670, promulgated on July 21, 2010, the dispositive portion of which reads, as follows:

Considering the foregoing, and after due deliberation, the Commission RESOLVED, as it hereby RESOLVES, to authorize all Regional Election Directors to negotiate with the printer which submitted the lowest price and could meet the quantity, quality and time requirements in their respective areas of jurisdiction provided said cost does not exceed the following price ceilings:

WHEREAS, the Commission, pursuant to Minute Resolution No. 10-0899, promulgated on September 14, 2010, approved the payment for the printing and delivery of application forms covered by the printing contracts entered into by the Regional Election Directors, citing the presence of the principle of "economy and consistency" as explained by then Resident Auditor Resurreccion C. Quieta, more particularly, that while the procurement of said forms was not conducted through public bidding, the government stands to be benefitted as the price is lower compared to the 2007 price range;

WHEREAS, the price ceiling established under Minute Resolution No. 10-0670 appear to be still applicable under the current open market;

NOW, THEREFORE, by virtue of the powers vested in it by the Constitution, the Omnibus Election Code, Republic Act No. 8189 and other election laws, the Commission RESOLVED, as it hereby RESOLVES, to authorize the Regional Election Directors to procure application forms intended for use in their respective regions in connection with the resumption of the system of continuing registration of voters on April 1, 2011 in non-ARMM areas in accordance with the following guidelines:

  1. The price ceilings for the procurement of application forms shall be the same as those prescribed under Minute Resolution
    No. 10-0670, inclusive of the cost of delivery by the printer to the Offices of the Provincial Election Supervisors, to wit:

  3. The application forms to be procured shall be based on the quantity, design and specifications approved pursuant to Minute Resolution No. 11-0187, promulgated on February 1, 2011. For this purpose, the Allocation Committee shall immediately inform the Regional Election Directors of the total quantity of application forms for each region, including the breakdown thereof per province, as well as the design and specification of said forms;
  4. The quantity of the application forms to be delivered by the printer may be on staggered basis, provided sufficient quantity
    shall be made available at the Offices of the Election Officers in time for the resumption of the system of continuing registration of voters on April 1, 2011; and
  5. Upon award to the printer which submitted the lowest price, and could meet the quantity, quantity and time
    requirements, the Regional Election Directors shall forward all procurement documents to the Finance Services Department, for processing and payment. For this Purpose, the Finance Services Department shall advice the Regional Election Directors of all the procurement documents required for the processing and payment of the contract for the printing and delivery of the application forms.

Let the Allocation Committee and Finance Services Department implement this Resolution.
