IN THE MATTER OF THE OMNIBUS RESOLUTION ANNULLING THE SECOND OR SUBSEQUENT REGISTRATION OF ANY REGISTERED VOTER WHILE HIS FIRST REGISTRATION SUBSISTS
In the matter of the Omnibus Resolution annulling the second or subsequent registration of any registered voter while his first registration subsists.
Earlier the Commission issued Minute Resolution No. 00-0787 promulgated 11 April 2000 which is quoted hereunder, to wit:
"This pertains to the Memorandum dated 05 April 2000 of Executive Director Resurreccion Z. Borra, relative to the list of voters in the 1st and 2nd Districts of Pasay City with double multiple registration as of October 1, 1999, which reads:
'Please find the fifteen (15) pages of print-outs of the above subject containing the names of 162 registered voters with double multiple registration from the Management Information System of this Commission.
The above listing is as of October 1, 1999. The recent CVL as of January 17, 2000 cut-off date is still to be verified.
The CVL verification covered 210,671 registered voters of Pasay City. The balance of 3,405 names from the present 211,076 registered voters are still to be verified by the MIS through the CVL from the EOs of Pasay City.
It was found that even in Mercedes, Camarines Norte, nine registered voters were found to have registered twice.
The Commission, after due deliberation, RESOLVED as it hereby RESOLVES to rule as follows:
- That while the first registration of any voter subsists, any subsequent registration thereto is void ab initio;
- That to allow the names of such double/multiple registrants to remain in the computerized voters list is to tolerate padding thereof;
- That it is imperative to delete the names of double/multiple registrants from the computerized voters list, their subsequent registration being invalid;
- That the deletion of names of double/multiple registrants shall be without prejudice to their prosecution for committing double/multiple registration;
- That Election Officers concerned shall keep the VRRs corresponding to the deleted names as evidence in court;
- To authorize the EOs of National Capital Region who are full fledged lawyers to conduct the preliminary investigation of double/multiple registrants in NCR;
- That for the purpose of the recall elections on April 15, 2000 in Pasay City, Mercedes, Camarines Norte, General Tinio, Nueva Ecija and Jimalalud, Negros Oriental, the election officers concerned shall post the names of multiple/double registrants in the different precincts and to furnish the different candidates with copies thereof for whatever action they may deem proper before, during and after election.
Let the Law, the Election and Barangay Affairs and the Election Records and Statistics Departments, accordingly implement this resolution."
the Commission after due deliberation, RESOLVED as it hereby RESOLVES to extend the coverage of Minute Resolution No. 00-0787 throughout the country and hereby adopts items 1 to 5 thereof as follows:
- That while the first registration of any voter subsists, any subsequent registration thereto is void ab initio;
- That to allow the names of such double/multiple registrants to remain in the computerized voters list is to tolerate padding thereof;
- That it is imperative to delete the names of double/multiple registrants from the computerized voters list, their subsequent registration being invalid;
- That the deletion of names of double/multiple registrants shall be without prejudice to their prosecution for committing double/multiple registration;
- That Election Officers concerned shall keep the VRRs corresponding to the deleted names as evidence in court;
RESOLVED, further, to authorize all full fledged lawyers in the field who are either RED, ARED, Regional Attorney, PES, CEO or EO to conduct the preliminary investigation of double/multiple registrants in their respective areas of jurisdiction.
This resolution is without prejudice to the following resolutions earlier approved by the Commission:
