Resolution No. 10287

Promulgation: 06 April 2018

IN THE MATTER OF ADOPTING PERTINENT RESOLUTIONS PROMULGATED AND/OR ADOPTED IN CONNECTION WITH THE 14 MAY 2018 BARANGAY AND SANGGUNIANG KABATAAN ELECTIONS (BSKE) FOR PURPOSES OF THE 05 MAY 2018 RECALL ELECTIONS FOR MAYOR OF CABADBARAN CITY, AGUSAN DEL NORTE

WHEREAS, in Resolution No. 10247 dated 15 January 2018, the Commission on Elections (Commission) adopted the following resolutions in connection with the 14 May 2018 Barangay and Sangguniang Kabataan Elections (BSKE):

  1. "Resolution No. 10197 dated 14 September 2017 entitled "Rules and Regulations on: (1) The Ban on Bearing, Carrying or Transporting of Firearms or Other Deadly Weapons; and (2) The Employment, Availment or Engagement of the Services of Security Personnel or Bodyguards During the Election Period of the October 23, 2017 Barangay and Sangguniang Kabataan (SK) Elections";
  2. Resolution No. 10198 dated 14 September 2017 entitled "Consolidated Resolution for: 1) Guidelines on the Establishment and Operation of Comelec Checkpoints; and 2) Instructions for the Conduct of Preliminary Examinations of Violations of the Ban on Firearms, Other Deadly Weapons and Security Personnel, In Connection With the October 23, 2017 Barangay and Sangguniang Kabataan Elections (BSKE");
  3. Resolution No. 10199 dated 14 September 2017 entitled "In the Matter of Placing Some Areas In the Country Under Comelec Control In Connection With the October 23, 2017 Barangay and Sangguniang Kabataan Elections (BSKE)";
  4. Resolution No. 10201 dated 26 September 2017 entitled "Rules and Regulations on the Liquor Ban In Connection With the October 23, 2017 Barangay and Sangguniang Kabataan (SK) Elections"; and
  5. Resolution No. 10205 dated 26 September 2017 entitled "In the Matter of Exempting the Philippine National Police (PNP) and the Armed Forces of the Philippines (AFP) from the Coverage of Sections 261 (h) and (r) of the Omnibus Election Code In Connection With the October 23, 2017 Synchronized Barangay and Sangguniang Kabataan (SK) Elections"'

WHEREAS, the Commission promulgated Resolution No. 10274 dated 27 March 2018 setting the date of the recall elections for Mayor of Cabadbaran City to 05 May 2018, and prescribing the calendar of activities and periods of prohibited acts in connection with the said elections;

NOW, THEREFORE, the Commission, by virtue of the powers vested in it under the Constitution, the Omnibus Election Code, and other election laws, RESOLVED, as it hereby RESOLVES, to ADOPT the abovementioned Resolutions for purposes of the 05 May 2018 insofar as applicable, subject to the activities, periods and dates prescribed in Resolution No. 10274 dated 27 March 2018.

RESOLVED, further, to include candidates for Mayor in the recall elections in Cabadbaran City, Agusan del Norte, as among those who may employ, avail, or engage services of security personnel or bodyguards under Section 13 of Comelec "Resolution No. 10197 dated 27 March 2018.

This Resolution shall take effect on the seventh (7th) day after its publication in two (2) daily newspapers of general circulation in the Philippines.

The Education and Information Department of the Commission shall cause the immediate publication of this Resolution in two (2) daily newspapers of general circulation in the Philippines.
