Resolution No. 9106

WHEREAS, on November 13, 2010, the Commission conducted Special Elections in the following areas in Lanao del Sur, to wit: (a) ten (10) clustered precincts in the Municipality of Kapai and, (b) six (6) clustered precincts in the Municipality of Calanogas;

WHEREAS, the Municipal Board of Canvassers of the above municipalities transmitted the results of the Special Elections to the PBOC of Lanao del Sur;

WHEREAS, after canvassing and consolidation of results, the Provincial Board of Canvassers (PBOC) of Lanao del Sur for the November 13, 2010 Special Elections adjourned on November 17, 2010;

WHEREAS, for the national positions, the Consolidated Statement of Votes (SOV) and the Certificate of Canvass (COC) of the PBOC Lanao del Sur did not include the results of the May 10, 2010 National and Local Elections for Kapai and Calanogas;

WHEREAS, the PBOC deducted the result of the May 10, 2010 elections, in Tugaya, from the November 13, 2010 elections results of Tugaya;

NOW, THEREFORE, the Commission on Elections, by virtue of its mandate vested by the Constitution, the Omnibus Election Code and other election laws, RESOLVED, as it hereby RESOLVES to direct the Provincial Board of Canvassers (PBOC) of Lanao del Sur to re-convene, after due notice to all parties, not later than December 03, 2010 for the purpose of amending the Provincial Certificate of Canvass, for the national positions, as follows:

1. to include the May 10, 2010 National Elections results for the Municipalities of Kapai and Calanogas;
2. for the Municipality of Tugaya, to reinstate the results which were deducted from the total results reflected in the Provincial SOV/COC of November 13, 2010;
3. to submit Supplemental Consolidated Statement of Votes to reflect the above amendments.
