Minute Resolution No. 10-0042

IN THE MATTER OF THE PUBLICATION OF THE CERTIFIED LIST OF CANDIDATES
FOR THE MAY 10, 2010 NATIONAL AND LOCAL ELECTIONS

This pertains to the Memorandum dated January 11, 2010 of the Law Department on the publication of the Certified List of Candidates for the May 10, 2010 National and Local Elections.

The Memorandum of the Law Department is hereunder quoted, to wit:

"On January 04, 2009, the Law Department came up with the required List of Candidates for both national and local positions for the coming 2010 National and Local Elections. The said list is necessary to allow the Information Technology Department (ITD) to prepare the 'blue print of the list of candidates' that will be used for the printing of the names of the candidates in the ballots. On the same day, a representative from ITD collated from the Law Department all the soft copies of the said list of all candidates from all the regions of the country.

For purposes of transparency and accuracy in the final printing of the names of the candidates in the Certified List of Candidates, this Department is recommending the following measures to be adopted:

a) Candidates running for national positions - The list should be published in two (2) newspapers of general circulation, in addition to its being posted in the official website of the Commission;

b) Candidates running for local positions - The list should only be posted in the official website of the Commission in order to save on costs;

Any misspelling or omission of names of the candidates or an error in the entry of information in the Certified List of Candidates, must be reported to the Law Department within five (5) days from the date of publication/posting. The Law Department will then enter the necessary correction in its Candidates Information Management System (CIMS) and generate a hard copy for its own file. The Law Department shall then transmit the changes to ITD.

After the five-day period, the Commission shall be relieved from responsibility or liability for any matter not brought to its attention.

For your Honors' approval."

For purposes of transparency and accuracy in the final printing of the names of the candidates in the Certified List of Candidates for both national and local positions for the forthcoming 2010 National and Local Elections, the Commission RESOLVED, as it hereby RESOLVES, to adopt the foregoing recommendations of the Law Department, as follows:

1) Candidates running for national positions - The list should be published in two (2) newspapers of general circulation, in addition to its being posted in the official website of the Commission; and

2) Candidates running for local positions - The list should only be posted in the official website of the Commission in the official website of the Commission in order to save on costs;

RESOLVED, moreover, chat any misspelling or omission of names of the candidates or an error in the entry of information in the Certified List of Candidates must be reported to the Law Department within five (5) days from the date of publication/posting. The Law Department shall then enter the necessary correction in its Candidates Information Management System (CIMS) and generate a hard copy for its own file, and thereafter, shall transmit the changes to the Information Technology Department.

RESOLVED, finally, that after the five-day period, the Commission shall be relieved from responsibility or liability for any matter not brought to its attention.

Let the Law Department implement this resolution.
