Minute Resolution No. 09-0544

This pertains to the Memorandum dated August 20, 2009 of Deputy Executive Director for Operations Bartolome J. Sinocruz, Jr., relative to Republic Act No. 9591 on the allocation of one (1) Legislative District for the City of Malolos.

The Memorandum of Director Sinocruz reads:

"This pertains to the attached machine copy of Republic Act 9591, entitled 'AN ACT AMENDING SECTION 57 OF REPUBLIC NO. 8754, OTHERWISE KNOWN AS THE CHARTER OF THE CITY OF MALOLOS,' which lapsed into law on 01 May 2009, as it was unsigned by the President of the Republic of the Philippines. It was published on May 14, 2009 and became effective fifteen (15) days thereafter, or on May 30, 2009.

RA 9591 amended Section 57 of RA 8754, or the Charter creating the City of Malolos, which states:

'Section 57. Legislative District. - The City of Malolos shall have its own legislative district to commence in the next national elections after the effectivity of this Act.'

It has been almost ten (10) years after RA 8754 became effective on the date of its ratification in a plebiscite conducted in the City of Malolos on 18 December 1999, but it has not been allocated with a lone legislative district provided for in the provisions of RA 8754.

The provisions of RA 9591 fortified the creation of the lone district by providing that the incumbent representative of the First District of Bulacan shall continue to represent the City of Malolos until the new representative of the lone district of the City of Malolos shall have been elected and qualified.

Considering the foregoing, the undersigned recommends that the Commission implement RA 9591, by providing for the additional allocation of the lone legislative district for the City of Malolos, to be included for the May 10, 2010 National Elections.

In order to implement Republic Act No. 9591, entitled "AN ACT AMENDING SECTION 57 OF REPUBLIC ACT NO. 8754, OTHERWISE KNOWN AS THE CHARTER OF THE CITY OF MALOLOS", the Commission RESOLVED, as it hereby RESOLVES, to approve the recommendation of Deputy Executive Director for Operations Bartolome J. Sinocruz, Jr. to provide additional allocation of the lone legislative district for the City of Malolos to be included in the May 10, 2010 National Elections.

Let the Executive Director and the Deputy Executive Director for Operations implement this resolution.
