The public is hereby informed of the clarifications in the Bidding Documents for the Public Bidding of Provision of Special Courier Services for Luzon Areas for the Shipment of Documents, Materials and Equipment Relative to the Regular Operations of the Commission on Elections.
- Submission of Bids for this project is moved from February 13, 2019 to February 14, 2019 9:00AM at the BAC Secretariat Office, 7th floor, Palacio del Gobernador, Intramuros, Manila. Late bids shall not be accepted.
The Opening of Bids is likewise moved from February 13, 2019 to February 14, 2019 10:00AM at the Club Intramuros Golf Club, Bonifacio Drive, Intramuros, Manila. - Queries from the prospective bidders:

"I noticed Ma’am doon sa financial proposal wala po siyang declared value for the materials and the equipment?" 2. Please see attached Annexes "E" and "F". 3. "So maglalagay kami ng provision na ilang percent for the declared value sa proposal namin po?" 3. The accredited provider cannot impose additional administrative and operational costs without seeking prior written approval from the COMELEC.Should be all in, no additional charges/costs. 4."Some documents Ma’am are subpoenas and check, kasi iyong sub phoenas hindi tinatanggap ng consignee. Ano ang gagawin namin pag hindi nila tinanggap. And the check may value po…" 4. In the possibility that the consignee refuses to receive the shipment for any ground except for mis-delivery and damaged equipment, the same must be immediately reported in writing to ASD for its appropriate action, stating the name of consignee, date and time of delivery and the reason for such refusal. Actions by ASD on such information shall be immediately conveyed to the accredited SCS provider.By their very nature, checks have value. However, the IRD cannot determine, much more declare, the cost of each check as it is received in a sealed envelope. Furthermore, the IRD has no authority to open sealed envelopes. 5. "Ah… worst Ma’am, nawala iyong sub-poena or cheke, ano ba ang provisions sa amin provider? Or penalties?" 5. The accredited SCS provider shall be liable for liquidated damages or termination for default to the extent that its delay in performance or other failure to perform its obligations except in cases of force majeure or an event which the accredited SCS provider could not foresee, or which though foreseen was inevitable. It shall not include ordinary unfavorable weather conditions; and any other cause effects of which could have been avoided with the exercise of reasonable diligence by accredited SCS provider.
The liability of the accredited SCS provider for any loss, theft, robbery, damage to document/equipment and for such similar circumstances shall be governed by the pertinent provisions of the Civil Code and other relevant laws. The accredited SCS provider shall notify COMELEC not later than 24 hours upon discovery of such loss, theft, robbery or damage. - Annex E - Assumption of Cargoes and Declared Value and Annex F - Usual Cargoes for Delivery are attached herein making part of the Bidding Documents.
All terms, conditions and instructions to bidders specified in the Bidding Documents inconsistent with this Bid Bulletin are hereby superseded and modified accordingly.
