PROTOCOL FOR THE VERIFICATION OF OFFICIAL BALLOTS BY THE ELECTORAL BOARDS, SUPPLEMENTING SECTION 71 OF RESOLUTION NO. 10460 IN CONNECTION WITH THE MAY 13, 2019 NATIONAL AND LOCAL ELECTIONS.
WHEREAS, Section 71 of Resolution No. 10460 reads:
"SEC. 71. Preliminaries to the Voting. - The EB shall:
- Meet at the polling place not later than five o'clock in the morning of Election Day;
- Ensure that the VCM Box and the ballot box are inside the polling place;
- Set-up the polling place. As far as practicable, the EB shall designate at least five (5) seats exclusively for PWDs, SC and heavily pregnant voters;
- Post one (1) copy of the PCVL of each precinct in the cluster, near or at the door of the polling place, preferably the pages/sheets are spread out to give free access to voters who are checking their names in the list, if there is a space;
- Show to the watchers and the public present that the:
- VCM box is sealed;
- Ballot box is empty and thereafter, lock with four (4) seals; and
- Package of official ballots is duly sealed, and thereafter, break the seal.
WHEREAS, there is a need to supplement Section 71, by providing the protocol for the verification of the official ballots, to ensure that the ballot ID and quantity of the official ballots assigned to a particular clustered are correct.
NOW THEREFORE, the Commission, by virtue of the powers vested in it by the 1987 Philippine Constitution, Omnibus Election Code, Republic Act No. 8436 amended by Republic Act No. 9369 and other election laws, RESOLVED, as it is hereby RESOLVES, to supplement Section 71, to now read as follows:
"SEC. 71. Preliminaries to the Voting. - The EB shall:
- Meet at the polling place not later than five o'cloclc in the morning of Election Day;
- Ensure that the VCM Box and the ballot box are inside the polling place;
- Set - up the polling place. As far as practicable, the EB shall designate at least five (5) seats exclusively for PWDs, SC and heavily pregnant voters;
- Post one (1) copy of the PCVL of each precinct in the cluster, near or at the door of the polling place, preferably the pages/sheets are spread out to give free access to voters who are checking their names in the list, if there is a space;
- Show to the watchers and the public present that the:
- VCM box is sealed;
- Ballot box is empty and thereafter, lock with four (4) seals; and
- Package of official ballots is duly sealed, and thereafter, break the seal;
- After opening the package containing the official ballots, the EB Chairperson shall check the quantity and ballot IDs of the official ballots assigned to the clustered precinct to check if the quantity is correct, based on the number of registered voters and whether the ballot IDs are all
the same.
4.1.1 If the quantity of ballots in the package is not accurate and if there are ballots of different ballot IDs. Record in the Minutes and report the matter to the EO, who shall then submit a report to the Command Center. The same recording and reporting protocol shall be observed in 4.1.2, 4.1.3 and 4.1.4;
4.1.2 If there are ballots of different IDs, separate these ballots. Do not issue these ballots to the voters. Issue only those with ballot ID that is assigned to the precinct;
4.1.3 If the destination of the official ballots with different ballot ID is within the voting center, the DESO shall cause the delivery of the ballots to the EB concerned;
4.1.4 If the destination of the official ballots of different ballot ID is in another voting center but within the same municipality/city, the EO shall cause the delivery to its destination;
4.1.5 If the destination of the official ballots of different ballot ID is to another municipality/city but within the same province, the PES shall cause the delivery and submit report to the Command Center;
4.1.6 If the destination of the official ballots of different ballot ID is to another municipality/city of another province, the concerned RED shall arrange for the delivery of the ballots to its destination and report the matter to the Command Center;
4.1.7 In all instances of delivery/transfer of official ballots under 4.1.2, 4.1.3, 4.1.4, 4.1.5 and 4.1. 6, the EB shall:
4.1.7.1 Announce the delivery/transfer of the official ballots; and
4.1.7.2 Request the watchers and representative of the citizens' arms to accompany the DESO/EO/PES/RED or their representatives, to witness the delivery/transfer.
4.1.8 Coordinate with the PNP/AFP to secure the delivery/transfer of the official ballots if the delivery/transfer involves different voting centers/ municipalities/ cities/ provinces/regions;
4.1.9 In case the delivery/transfer is not feasible, concerned field official shall report the matter to the Command Center for appropriate action.
- In case, the number of official ballots are less than the number of registered voters, and there are voters waiting for their turn to vote, the EB shall:
IN NON - VRVM PILOT AREAS
5.1.1 Establish the identity of the voters through the EDCVL as provided under Section 72 (b) 1, 2, 3 4 and 5, of Resolution No. 10460;
5.1.2 Prepare the verified list of names of voters not accommodated due to lack of official ballots;
5.1.3 Inform the DESO, who shall coordinate with the EBs of the other polling places with available ballots to allow the voters to cast their votes;
5.1.4 Instruct said voters to vote in another polling place within the same voting center through the guidance of the DESO/DESO SS;
5.1.5 Record in the Minutes, the names of the voters;
5.1.6 The EB with available official ballots shall also record in the Minutes the names of voters who were allowed to vote in their assigned clustered precinct pursuant to this Resolution. Attached to the Minutes, the verified list of voters;
IN VRVM PILOT AREAS
5.1.7 The EB shall conduct the verification of voters provided under Sections 10, 11 and 12 of Resolution 10522 before the list is prepared as provided above; and
5.1.8 The verification receipt shall be presented to the EB with available official ballots before the voters are allowed to vote.
Further, the Personnel Department through the EOs are directed to include the above protocol during the refresher course of the EBs.
This Resolution shall take effect on the seventh (7th) day after its publication in two (2) daily newspapers of general circulation in the Philippines. The Education and Information Department (EID), shall cause the publication of this Resolution and provide copies to the REDs, PESs, and EOs.
