IN THE MATTER OF FURTHER AMENDING RESOLUTION NO. 10420 ENTITLED "RULES AND REGULATIONS GOVERNING: 1) POLITICAL CONVENTIONS; 2) SUBMISSION OF NOMINEES OF GROUPS OR ORGANIZATIONS PARTICIPATING UNDER THE PARTY-LIST SYSTEM OF REPRESENTATION; AND 3) FILING OF CERTIFICATES OF CANDIDACY AND NOMINATION OF AND ACCEPTANCE BY OFFICIAL CANDIDATE OF REGISTERED POLITICAL PARTIES OR COALITIONS OF POLITICAL PARTIES IN CONNECTION WITH THE MAY 13, 2019 NATIONAL AND LOCAL ELECTIONS"
WHEREAS, on 7 September 2018, the Commission promulgated Resolution No. 10420 entitled "Rules and Regulations Governing: 1) Political Conventions; 2) Submission of Nominees of Groups or Organizations Participating under the Party-List System of Representation; and 3) Filing of Certificates of Candidacy and Nomination of and Acceptance by Official Candidates of Registered Political Parties or Coalitions of Political Parties in connection with the May 13, 2019 National and Local Elections".
WHEREAS, on 1 October 2018, the Commission promulgated Resolution No. 10430 amending Sections 2, 7, 18, 29, 31 and 33 of Resolution No. 10420.
WHEREAS, under Section 18 of Resolution No. 10430, the period for filing of Certificates of Candidacy was reset to October 11-12 and 15-17, 2018.
WHEREAS, under Section 22 of Resolution No. 10420, the posting of the tentative list of candidates was set on November 5, 2018.
WHEREAS, under Section 23 of Resolution No. 10420, the last day to file a Request for Correction on the name to appear on the official ballot was set on November 9, 2018.
WHEREAS, under Section 33 of Resolution No. 10420, as amended by Resolution No. 10430, the deadline for substitution due to withdrawal was set on November 29, 2018.
WHEREAS, in view of the resetting of the filing of Certificates of Candidacy, there is a need to reset the posting of the tentative list of candidates and the last day to file Request for Correction on the name to appear on a later date.
NOW, THEREFORE, the Commission on Elections, by virtue of the power vested in it under the Constitution, the Omnibus Election Code, and other election laws, RESOLVED, as it hereby RESOLVES, to amend Sections 22 and 23 of Resolution No. 10420, viz.:
"Section 22. Posting of the Tentative List of Candidates for Purposes of the Name to Appear on the Official Ballot. - The tentative List of Candidates will be posted starting on November 19, 2018 at the COMELEC website at www.comelec.gov.ph and at the offices where the COCs were filed for purposes of checking the name to appear on the official ballot. Aspirants are encouraged to check their names to appear on the official ballots.
The name to appear on the ballot of substitute candidates who will file their Certificates of Candidacy and Certificates of Nomination and Acceptance from November 19-29, 2018 shall be posted on November 30, 2018 at the COMELEC website at www.comelec.gov.ph and at the offices where the COCs were filed for purposes of checking the name to appear on the official ballot."
"Section 23. Last Day to File Request for Correction on the Name to Appear on the Official Ballot. - The last day to file a Request for Correction on the name to appear on the official ballot shall be on November 23, 2018 in order to reflect the desired name of the candidate in the official ballot, subject to the requirements of Sections 19-21 hereof. No request for correction shall be entertained after said date.
Substitute candidates shall have until December 7, 2018 to file a Request for Correction on the name to appear on the official ballot, subject to the requirements of Sections 19-21 hereof. No request for correction shall be entertained after said date."
This Resolution shall take effect on the seventh day after its publication in two daily newspapers of general circulation in the Philippines.
