IN THE MATTER OF THE IMPLEMENTING RULES AND REGULATIONS OF REPUBLIC ACT NO. 11077 ENTITLED "AN ACT REAPPORTIONING THE PROVINCE OF AKLAN INTO TWO (2) LEGISLATIVE DISTRICTS"

WHEREAS, on September 24, 2018, the President of the Republic of the Philippines approved Republic Act No. 11077 entitled "An Act Reapportioning the Province of Aklan into Two (2) Legislative Districts";

WHEREAS, Section 3 of RA No. 11077 states that the Commission on Elections shall issue the necessary rules and regulations to implement the law within thirty (30) days upon the effectivity thereof.

WHEREAS, Section 5 of RA No. 11077 provides that the law shall take effect fifteen (15) days after its publication in the Official Gazatte or in any newspaper of general circulation.

NOW, THEREFORE, the Commission, by virtue of the powers vested in it by the 1987 Philippine Constitution and other relevant election laws, RESOLVED, as it is hereby RESOLVES, to promulgate and approve the following "Implementing Rules and Regulations of RA No. 11077 entitled "An Act Reapportioning the Province of Aklan into Two (2) Legislative Districts".

Section 1. Title. - These Rules and Regulations shall be referred to as the Implementing Rules and Regulations (IRR) of RA No. 11077 entitled "An Act Reapportioning the Province of Aklan into Two (2) Legislative Districts"

Section 2. Legislative Districts and Composition. - The Province of Aklan shall be reapportioned into two (2) legislative districts, with each district composed of the following:

  1. First Legislative District: Altavas, Balete, Banga, Batan, Kalibo, New Washington, Libacao and Madalag (8);
  2. Second Legislative District: Buruanga, Ibajay, Lezo, Makato, Malay, Malinao, Nabas, Numancia and Tangalan (9).

Section 3. Incumbent Representatives. - The incumbent Representative of the Lone Legislative District of the Province of Aklan shall continue to represent the legislative district until noon of the 30th of June 2019.

Section 4. First Regular Elections. - The first regular elections in the two (2) Legislative Districts of the Province of Aklan shall be held on 13 May 2019 National and Local Elections.

Section 5. Allocation of Members/House of Representatives. - Each legislative district in the Province of Aklan shall have one (1) Representative in the House of Representatives, as follows:

Section 6. Allocation of Members, Sangguniang Panlalawigan. - Each legislative district in the Province of Aklan shall have five (5) members in the Sangguniang Panlalawigan, as follows:

Second Legislative District 5

Section 7. Place and Period For Filing Certificates of Candidacy and Certificates of Nomination and Acceptance. - The Certificates of Candidacy and Certificates of Nomination and Acceptance, if any, shall be filed at the Office of the Provincial Election Supervisor of Aklan from October 11, 12, 15-17, 2018 at 8:00 AM to 5:00 PM only.

There shall be no further extension on the filing of the Certificates of Candidacy and Certificates of Nomination and Acceptance.

Section 8. Repealing Clause. - All rules and regulations which are inconsistent with this IRR are hereby repealed or modified accordingly.

Section 9. Publication. - The Education and Information Department (EID) of the Commission shall cause the publication of this IRR in two (2) newspapers of general circulation in the Philippines.

Section 10. Effectivity - This IRR shall take effect on the seventh (7th) day after the completion of its publications in two (2) newspapers of general circulation in the Philippines.
