IN THE MATTER OF THE IMPLEMENTING RULES AND REGULATIONS OF REPUBLIC ACT NO. 11078 ENTITLED, "AN ACT SEPARATING THE CITY OF CALAMBA FROM THE SECOND LEGISLATIVE DISTRICT OF THE PROVINCE OF LAGUNA TO CONSTITUTE THE LONE LEGISLATIVE DISTRICT OF THE CITY OF CALAMBA"
WHEREAS, on September 24, 2018, the President of the Republic of the Philippines approved Republic Act No. 11078 entitled "An Act Separating the City of Calamba from the Second Legislative District of the Province of Laguna to constitute the Lone Legislative District of the City of Calamba"
WHEREAS, Section 3 of RA No. 11078 states that the Commission on Elections shall issue the necessary rules and regulations to implement the law within thirty (30) days after its effectivity.
WHEREAS, Section 5 of RA No. 11078 provides that the law shall take effect fifteen (15) days after its publication in at least two (2) newspapers of general circulation.
NOW, THEREFORE, the Commission, by virtue of the powers vested in it by the 1987 Philippine Constitution and other relevant election laws, RESOLVED, as it is hereby RESOLVES, to promulgate and approve the following "Implementing Rules and Regulations of RA No. 11078 entitled "An Act Separating the City of Calamba from the Second Legislative District of the Province of Laguna to constitute the Lone Legislative District of the City of Calamba".
Section 1. Title. - These Rules and Regulations shall be referred to as the Implementing Rules and Regulations (IRR) of RA No. 11078 entitled "An Act Separating the City of Calamba from the Second Legislative District of the Province of Laguna to constitute the Lone Legislative District of the City of Calamba"
Section 2. Lone Legislative District of Calamba City. - The City of Calamba is hereby separated from the Second Legislative District of the Province of Laguna to constitute the Lone Legislative District of the City of Calamba.
Section 3. Holdover. - The Incumbent Representative of the present Second Legislative District of the Province of Laguna shall continue to represent the district until noon of the 30th of June 2019.
Section 4. First Regular Elections. - The first regular elections in the Lone Legislative District of the City of Calamba shall be held on 13 May 2019 National and Local Elections.
Section 5. Election of Member House of Representatives. - The City of Calamba shall elect its own Member in the House of Representatives.
Section 6. Election of Member Sangguniang Panlalawigan. - The City of Calamba shall be part of the Second (2nd) Provincial District of Laguna.
Section 7. Number of Seats of Members of Sangguniang Panlungsod. - The City of Calamba shall have twelve (12) members in the Sangguniang Panlungsod.
Section 8. Place and Period for Filing Certificates of Candidacy and Certificates of Nomination and Acceptance. - The Certificates of Candidacy and Certificates of Nomination and Acceptance, if any, for the said positions shall be filed at the Office of the City Election Officer of Calamba City from October 11, 12, 15-17, 2018 at 8:00 AM to 5:00 PM only.
There shall be no further extension on the filing of the Certificates of Candidacy and Certificates of Nomination and Acceptance.
Section 9. Repealing Clause. - All rules and regulations inconsistent with this IRR are hereby repealed, amended or modified accordingly.
Section 10. Publication. - The Education and Information Department (EID) of the Commission shall cause the publication of this IRR in two (2) newspapers of general circulation in the Philippines.
Section 11. Effectivity Clause. - This IRR shall take effect on the seventh (7th) day after the completion of its publications in two (2) newspapers of general circulation in the Philippines.
