IN THE MATTER OF AMENDING RESOLUTION NO. 10420 ENTITLED "RULES AND REGULATIONS GOVERNING: 1) POLITICAL CONVENTIONS; 2) SUBMISSION OF NOMINEES OF GROUPS OR ORGANIZATIONS PARTICIPATING UNDER THE PARTY-LIST SYSTEM OF REPRESENTATION; AND 3) FILING OF CERTIFICATES OF CANDIDACY AND NOMINATION OF AND ACCEPTANCE BY OFFICIAL CANDIDATES OF REGISTERED POLITICAL PARTIES OR COALITIONS OF POLITICAL PARTIES IN CONNECTION WITH THE MAY 13, 2019 NATIONAL AND LOCAL ELECTIONS"

WHEREAS, on 7 September 2018, the Commission promulgated Resolution No. 10240 entitled "Rules and Regulations Governing: 1) Political Conventions; 2) Submission of Nominees of Groups or Organizations Participating under the Party-List System of Representation; and 3) Filing of Certificates of Candidacy and Nomination of and Acceptance by Official Candidates of Registered Political Parties or Coalitions of Political Parties in connection with the May 13, 2019 National and Local Elections".

WHEREAS, under Section 2 of said Resolution, the last day to submit at the Law Department the List of Authorized Signatories with Specimen Signatures of Political Parties was set on September 28, 2018.

WHEREAS, under Sections 7 and 18, the filing of Certificate of Nomination, Certificate of Acceptance of Nomination of Party-List Groups, Certificates of Candidacy and Certificates of Nomination and Acceptance was set on October 1-5, 2018

WHEREAS, under Section 29, the period within which the Receiving Officer shall submit to the Law Department a Certified List of Candidates, via electronic mail, was set on a date not later than October 6, 2018.

WHEREAS, under Section 33, substitution due to withdrawal was allowed even beyond the deadline of November 29, 2018, provided that the substitute and the substituted have the same surnames.

WHEREAS, on 10 September 2018, both chambers of Congress adopted resolutions urging the Commission on Elections to move the original dates of the filing of the Certificates of Candidacy, among others, from October 1-5, 2018 to a later date, preferably from October 11-17, 2018.

NOW, THEREFORE, the Commission on Elections, by virtue of the power vested in it under the Constitution, the Omnibus Election Code, and other election laws, RESOLVED, as it hereby RESOLVES, to amend pertinent Sections of Resolution No. 10240, viz.:

"Section 2. Submission of List of Authorized Signatories and Specimen Signatures of Political Parties. - xxx

The last day to submit List of Authorized Signatories and Specimen Signatures shall be on October 5, 2018."

"Section 7. Period and Place for Filing Certificate of Nomination and Certificate of Acceptance of Nomination of Party-list Groups. - The Certificate of Nomination and Certificate of Acceptance of Nomination of party-list groups shall be filed from October 11-12 and 15-17, 2018, during office hours of 8:00 AM to 5:00 PM, before the Law Department, copy furnished the Office of the Clerk of the Commission.

There shall be no further extension on the filing of the Certificates of Nomination and Certificates of Acceptance of Nomination."

"Section 18. Period for Filing of Certificates of Candidacy. - The COC shall be filed on October 11-12 and 15-17, 2018, from 8:00 AM to 5:00 PM. xxx

There shall be no further extension on the filing of the Certificates of Candidacy and Certificates of Nomination and Acceptance."

"Section 29. Reports of the Certified List of Candidates Received. - xxx

The Receiving Officer shall submit a Certified List of Candidates to the Law Department through electronic mail not later than October 18, 2018."

"Section 31. Delivery and Distribution of the Reports on the Certificates of Candidacy Received. - The Record Book, Certified List of Candidates, CDs, and original copies of the COC s with documentary stamp affixed thereon, and CONAs shall, not later than October 21, 2018, be delivered and distributed as follows: xxx"

"Section 33. Substitution of Candidates in Case of Death, Disqualification or Withdrawal of Another. - An official candidate of a duly registered PP or Coalition who dies, withdraws or is disqualified for any cause after the last day for the filing of COCs may be substituted by a candidate belonging to, and nominated by, the same PP or Coalition.

No substitute shall be allowed for any independent candidate.

The substitute of a candidate who died, withdrew his candidacy, or was disqualified may file a COC for the Office affected on or before November 29, 2018 so that the name of the substitute will be reflected on the official ballots.

No substitution due to withdrawal shall be allowed after November 29, 2018.

The substitute for a candidate who died or was disqualified by final judgment, may file a COC up to mid-day of Election Day; Provided that, the substitute and the substituted have the same surnames.

If the death or disqualification should occur between the day before the election and mid-day of Election Day, the substitute candidate may file a COC with any Board of Election Inspectors, Election Officers, Provincial Election Supervisor or Regional Election Director, as the case may be, in the political subdivision where such person is a candidate, or in the case of a candidate for Senator, with the Law Department; Provided that, the substitute and the substituted candidate have the same surnames."

Finally, hereto attached are the amended Certificates of Candidacy as Annexes "F" to "F-11".

This Resolution shall take effect on the seventh day after its publication in two daily newspapers of general circulation in the Philippines.
