Resolution No. 10411

WHEREAS, the Commission on Elections is granted the power to enforce and administer all laws and regulations relative to the conduct of an election, plebiscite, initiative, referendum, and recall pursuant to Section 2 (1), Article IX-C of the 1987 Constitution. It is also granted the power to register, after sufficient publication, political parties, organizations, or coalitions which, in addition to other requirements, must present their platform or program of government.

WHEREAS, the power to register political parties includes the power to ensure that those in the registry list are still in existence and continue to comply with the requirements of the Constitution, the laws, and the rules of the Commission;

WHEREAS, the Commission needs to ensure that its records contain the correct and updated information in its political party registry considering the leadership ru1d there are nun1ber of those that have not participated in recent elections;

WHEREAS, the political parties currently registered in the Commission are:

1. National Constituency

2. Regional Constituency

3. Local Constituency

NOW THEREFORE, the Commission RESOLVED, as it hereby RESOLVES to prescribe the following:

Section 1. Submission of Sworn Information Update Statement. - Curently registered political parties or coalition of political parties are directed to submit a Sworn Information Update Statement (SIUS) (form attached as Annex "A" hereto) with the Office of the Clerk of the Commission, Intramuros, Manila, not later than 31 August 2018, which shall state, among others, the following:

1. Full name of political party, organization or coalition of political parties with acronym;
2. Principal headquarters and postal office address, including its branches and divisions, if any;
3. Date of Registration;
4. Constituency;
5. List of current officers, respective positions, and sex;
6. List of elected members in the immediately preceding national and local elections, respective elective positions, and sex;
7. List of members, including guest candidates, nominated for any elective positions, respective nominated elective positions, and sex;
8. Total number of members broken disaggregated by sex;
9. Updated contact number(s) and email address(es);

Henceforth, registered political parties and coalitions are required to submit their Annual Sworn Information Update Statement every 15th August of the year.

Section 2. Effect of failure to comply. - Failure to comply with the preceding requirement despite due notice shall constitute prima facie evidence that the political party or coalition of political parties concerned already ceased to exist, and shall be a cause for the party's and coalition's cancellation of registration.

Section 3. Notice and Hearing of Cancellation of Registration. - The Commission En Banc shall immediately set the cancellation proceedings for the political party or coalition of political parties that failed to submit the SIUS, where they would be given the opportunity to show cause why its registration should not be forfeited. Thereafter, the Commission En Banc shall resolve the matter.

Let the Clerk of the Commission implement this Resolution by furnishing all the foregoing parties a copy of this resolution at their registered address. The Education and Information Department (EID) of the Commission is hereby directed to cause the publication of this Resolution in two (2) daily newspapers of general circulation.
