IN THE MATTER OF AMENDING SECTIONS 4, 7, 8, 10 AND 11 OF RESOLUTION NO. 9987, "IN THE MATTER OF THE GUIDELINES IN THE CONDUCT OF THE SOURCE CODE REVIEW OF THE AUTOMATED ELECTION SYSTEM FOR THE 09 MAY 2016 NATIONAL AND LOCAL ELECTIONS."

WHEREAS, Resolution No. 9987 was promulgated on 14 September 2015 setting the guidelines for the conduct of the Local Source Code Review for the 09 May 2016 National and Local Elections;

WHEREAS, the conduct of a sufficient source code review by any interested party as provided under Section 12 of Republic Act No. 9369 will enhance public acceptance of and build public confidence in the Automated Elections System;

WHEREAS, Resolution No. 9987 sets the application period and the requirements to be complied withby the interested parties or groups;

WHEREAS, the application period for the Local Source Code Review has already lapsed;

WHEREAS, the code review room still has enough space to accommodate additional interested parties or groups to participate in the code review;

WHEREAS, Resolution No. 9987 provides that "the Commission may modify the above guidelines as it may deem fit and necessary.";

WHEREAS, in order to enhance the above-mentioned objectives, there is a need to amend Resolution No. 9987 to accommodate additional participants to conduct the local source code review subject to the physical limitations of the code review room;

NOW, THEREFORE, pursuant to the powers vested in it by the Constitution, the Omnibus Election Code, Republic Act No. 9369, and other election laws, the Commission has RESOLVED, as it hereby RESOLVES, to approve and adopt the following amendments to the existing guidelines in the conduct of the code review by interested parties or groups of the Automated Elections System for the 09 May 2016 National and Local Elections:

SECTION 1. Section 4 is hereby amended to read as follows:

SEC. 4. Participants. Parties or groups interested in conducting a local source code review must belong to any of the following:

  1. Political parties or coalition of parties duly registered and/or accredited by the Commission;
  2. Legitimate organizations or groups duly accredited by the Commission which includes duly accredited citizen's arms;
  3. Information Technology (IT) Groups known and recognized as existing in the IT community, preferably recommended by the Comelec Advisory Council (CAC) and/or the Information andTechnology Office (ICTO);
  4. Civil Society Groups known for their involvement in election reform activities as may be determined by the Commission;
  5. Host educational institution, if any.

For interested parties or groups submitting their manifestation of intent after 30 September 2015, preference shall be based on the time of their application.

SEC. 2. Section 7 is hereby amended to read as follows:

SEC. 7.Number of Reviewers; Limitations. Each interested party may appoint qualified reviewers for the source code review. However, only three (3) qualified reviewers from any group may be allowed to enter the code review room at a given time.

SEC. 3. Section 8 is hereby amended to read as follows:

SEC 8.Procedure. The interested party or groups must file a written request before the Commission's Steering Committee signifying its intent to participate in the local source code review. The written request shall be filed during regular office hours at the Office of Commissioner Luie Tito F. Guia, Commission on Elections. It shall be signed by the duly-authorized representative of the interested party or group.

SEC. 4. Section 10 is hereby amended to read as follows:

In the event that the required certifications cannot be produced immediately, the interested party or groups must submit a written explanation why the required certifications cannot be submitted.

In lieuof the above-mentioned certifications, the interested party or group may submit proof showing that the reviewer hasat least a five (5) year work experience in any IT-related field or a sufficient explanation showing expertise in C and C++ application development or in Java application depending on the system to be reviewed subject to the determination of the Commission.

The representation of the reviewer that he or she has at least a five (5) year work experience in any IT related field or any alternative showing expertise in C/C++ application development and Java application must be under oath.

SEC. 5. Section 11 is hereby amended to read as follows:

In case the requirements submitted are incomplete, interested parties or groups may be provisionally approved by the Ad-hoc Local Source Code Review Committee subject to the completion of the requirements.

The requirements must be completed within twenty (20) days from the filing of the written requests, otherwise, reviewers with complete requirements shall be given priority in filling the available slots for the review.

Let the Education and Information Department cause the immediate publication of this Resolution in two (2) daily newspapers of general circulation in the Philippines.
