RULES AND REGULATIONS FOR THE [1] REGISTRATION OF MEMBERS OF KATIPUNAN NG KABATAAN AND [2] REGISTRATION OF VOTERS FOR BARANGAY RELATIVE TO THE OCTOBER 31, 2016 SANGGUNIANG KABATAAN AND BARANGAY ELECTIONS
WHEREAS, the Commission on Elections (Commission) will conduct the Barangay Elections on October 31, 2016 pursuant to Republic Act. No. 9340 entitled “AN ACT AMENDING REPUBLIC ACT NO. 9164, RESETTING THE BARANGAY AND SANGGUNIANG KABATAAN ELECTIONS, AND FOR OTHER PURPOSES”;
WHEREAS, Section 31, Republic Act No. 10742 entitled “AN ACT ESTABLISHING REFORMS IN THE SANGGUNIANG KABATAAN CREATING ENABLING MECHANISMS FOR MEANINGFUL YOUTH PARTICIPATION IN NATION BUILDING, AND FOR OTHER PURPOSES” directs the Commission to “set a special registration of the Katipunan ng Kabataan which shall in no case be less than one (1) month and shall include Saturdays and Sundays”;
WHEREAS, Section 8 of Republic Act No. 8189 entitled “AN ACT PROVIDING FOR GENERAL REGISTRATION OF VOTERS, ADOPTING A SYSTEM OF CONTINUING REGISTRATION, PRESCRIBING THE PROCEDURES THEREOF AND AUTHORIZING THE APPROPRIATION OF FUNDS THEREFOR”, provides: “[N]o registration shall, however, be conducted during the period starting one hundred twenty (120) days before a regular election and ninety (90) days before a special election”;
WHEREAS, one hundred twenty days before the October 31, 2016 Barangay and Sangguniang Kabataan (SK) Elections falls on July 3, 2016;
WHEREAS, Section 29 of Republic Act No. 6646 entitled “AN ACT INTRODUCING ADDITIONAL REFORMS IN THE ELECTORAL SYSTEM AND FOR OTHER PURPOSES”) states that: “[I]f it should no longer be reasonably possible to observe the periods and dates prescribed by law for certain pre-election acts, the Commission shall fix other periods and dates in order to ensure accomplishment of the activities so voters shall not be deprived of their right of suffrage”;
WHEREAS, to ensure accomplishment of the pre-election activities so voters shall not be deprived of their right of suffrage, the Commission deemed it necessary to fix the registration period to July 15, 2016 to July 30, 2016 pursuant to Section 29 afore-mentioned.
NOW, THEREFORE, pursuant to the powers vested in it by the Constitution, the Omnibus Election Code, Republic Acts No. 8189, 10366, 10367, 10742 and other related elections laws, the Commission RESOLVED, as it hereby RESOLVES, to promulgate the following rules and regulations to govern the resumption of the system of continuing registration voters in connection to the October 31, 2016 (Monday) Barangay and SK Elections:
Section 1. Declaration of policy. - It is the policy of the Commission to establish a clean, complete, permanent and updated list of voters through the mandatory taking of photograph, fingerprints and signature (biometrics) in the registration process.
CHAPTER I
FILING OF APPLICATION
Sec. 2. Date, time and place for filing of applications. - Applications for [1] registration of voters for the Katipunan ng Kabataan (KK) and [2] registration of voters for the Barangay Elections shall be personally filed beginning July 15, 2016 (Friday) to July 30, 2016 (Saturday) inclusive of Saturdays, Sundays and Holidays with the Offices of the Election Officer (OEOs) of the city/municipality where the applicant resides, during office hours, from 8:00 AM to 5:00 PM.
When necessary, the Commission may adjust or suspend the registration period.
Sec. 3. Posting, Hearing and Approval/Disapproval of Applications. - The applications for registration, reactivation, change/correction of entries/and inclusion/reinstatement of records in the list of voters shall be heard by the Election Registration Board (ERB) at the OEO, in accordance with the following schedule:

If the last day to post notice, file opposition and hearing for approval/disapproval falls on a holiday or a non-working day, the same shall be done on the next working day.
Sec. 4. Who may register. - Any Filipino citizen who is not yet a registered voter, may apply for registration, provided he/she possesses the following qualifications:
- Katipunan ng Kabataan (KK):
- At least fifteen (15) but not more than thirty (30) years of age as of the day of the election (October 31, 2016);
- Residing in the barangay for at least six (6) months on election day;
- Not otherwise disqualified by law.
- Barangay Elections:
- At least eighteen (18) years of age on or before October 31, 2016 Barangay Elections;
- A resident of the Philippine for at least one (1) year and in the place wherein he/she proposes to vote, for at least six (6) months immediately preceding the October 31, 2016 Barangay Elections; and
- Not otherwise disqualified by law.
Sec. 5. Who are disqualified to register. - The grounds for disqualification on registration shall be governed by Section 10 of Resolution No. 9853
Sec. 6. Application Forms. - The following application forms shall be available at the OEO, FREE OF CHARGE:
- Annex “A” (CEF-1A - Application for Registration);
- Annex “B” (CEF-1C - Application for Reactivation);
- Annex “C” (CEF-1D - Application for Change/Correction of Entries/ and Inclusion/Reinstatement of Record in the List of Voters);
- Annex “D” - Supplementary Data Form; and
- Annex “E” - Certification for Registration of Applicant whose name is not found in the National List of Registered/Deactivated Voters (NLRDV);
For KK Registration (15 to 17 years old), the applicants shall accomplish the prescribed CEF-1A (Application for Registration). The EO shall stamp the word “KATIPUNAN NG KABATAAN” at the upper portion of the text box “Application for Registration” and in the Acknowledgement Receipt.
For purposes of the October 31, 2016 Sangguniang Kabataan and Barangay Elections, no applications for transfer of registration records from other district/city/municipality and transfer of registration records within the same city/municipality shall be entertained.
These application forms may also be downloaded from the COMELEC Website, www.comelec.gov.ph, to be printed on a long bond paper (preferably substance 20/70 gsm), after which the applicant shall manually fill-up the same in three (3) copies.
Sec. 7. Procedure for filing of applications: - In addition to the personal filing of applications and mandatory biometrics data capturing under Resolution No. 9853, VRM Operator shall perform the following procedures:
- For Katipunan ng Kabataan, fifteen [15] to seventeen [17] years of age:
- Log in into the Voter's Registration Systen (VRS).
- Click FILE Menu then click REGISTRATION.
- Perform the regular encoding of demographics and capturing of biometrics in the VRS.
- Tag as KK applicants.
- For applicants eighteen (18) to thirty (30) years old, the usual procedures in the conduct of registration voters for the Barangay Election shall be observed, subject to the extraction of their registration records under Section 11 of this Resolution.
CHAPTER II
ELECTION REGISTRATION BOARD ACTION
Sec. 8. Election Registration Board (ERB). - The provisions of Resolution No. 9853, not inconsistent herewith, with respect to the composition; substitution; disqualifications; compensation; notice of proceedings; preparation of list of applicants; procedures for processing of applications; approval/disapproval; publication of action on applications; and preparation and submission of minutes shall be applicable in the KK and Barangay registration of voters.
CHAPTER III
UPDATING OF RECORDS OF PWDs, SENIOR CITIZENS AND MEMBERS OF ICCs/IPs
Sec. 9. Updating of records; Assignment of Precincts; Extraction and Generation of Data of PWDs and Senior Citizens and members of ICCs/IPs. - The procedures for the updating of records, assignment of precincts, extraction, generation of data and withdrawal of intent to vote in accessible polling place of PWDs, Senior Citizens and members of ICCs/IPs as provided in Resolution No. 9853 shall be applicable.
CHAPTER IV
POST ELECTION REGISTRATION BOARD HEARING
Sec. 10. Extraction of Registration Records - After registration and before consolidation, the EOs shall extract the records of voters who are 18 to 30 years old and save the same in the separate file for purposes of SK database. The Information Technology Department (ITD) shall provide the technical procedures in the extraction of registration records of members of Katipunan ng Kabataan (KK) in the VRS.
Sec. 11 Assignment of Precinct Numbers - In the assignment of precinct number of first-time registrants for Barangay and Sangguniang Kabataan (SK) Elections, the following guidelines shall be observed:
- For 18 and above years old the procedure under Sec. 12 (c) Nos. 2 and 3 of Resolution No. 9853 shall apply.
- For voters ages 18 to 30 years old who will be extracted pursuant to Sec. 10 hereof, their precinct numbers shall begin with the prefix SK followed by the number of the regular precinct (mother/daughter) from where they have been extracted. (Ex. Regular precinct is 0001A, the SK counterpart precinct is SK1A
- For 15 to 17 years old, dummy precinct number shall be assigned during the registration. After the ERB hearing and during consolidation, these voters shall be assigned to SK precincts, which have been created as counterparts of regular established precincts in the same voting center, until the maximum number (200) of voter per precinct has been met.
In case all counterpart SK precincts have reached the 200 voter-limit, spin-off/daughter SK precincts shall be created with the same cap. - For SK voters who would like to avail of Accessible Polling Place (APP) under Republic Act. No. 10366, they shall be assigned to the counterpart SK precinct of the regular APP precinct assigned in the same voting center. (Ex. APP precinct number is 0005P1, the counterpart SK APP is SKP1).
In case there is no existing regular APP precinct, the PWD SK voters shall be assigned the precinct number APPSK1, APPSK2 and so on and so forth. The APPSK precinct shall follow the 200 voter-limit per precinct.
Sec. 12. Segregation, custody and back-up of database in Compact disc - The provisions of Resolution No. 9853 on the Segregation, custody and back-up of database in compact discs shall be applicable in the KK and Barangay registration of voters.
Sec 13. Submission of Quarterly Progress Report (QPR), Projects of Precincts (POPs) and SNPDAT. - The EO shall submit to the Election and Barangay Affairs Department hard and soft copy of the Quarterly Progress Report (QPRs) and Projects of Precincts (POP) (Sangguniang Kabataan and Barangay Elections) generated by the VRS and SNPDAT to the Information Technology Department (ITD) not later than August 20, 2016 (Saturday) without delay, through email, facsimile transmission or other fastest means available. ITD will issue appropriate instructions for the submission of SNPDAT.
Sec. 14. Compilation of VRRs - The original copies of the newly approved applications shall be complied in the Books of Voters.
For KK registrations, there shall be a separate Book of Voters for the approved applications which shall be complied per barangay and precincts.
Sec. 15. Petition for Inclusion of Voters in the List. - Any person whose application for registration has been disapproved by the ERB or whose name has been stricken out from the list may file with the court a petition to include his/her name in the permanent list of voters in his/her precinct at any time but not later than August 26, 2016 (Friday). It shall be supported by a certificate of disapproval of his/her application and proof of service of notice of his/her petition upon the ERB. The petition shall be decided within fifteen (15) days after its filing.
If the decision is for the inclusion of the voters’ name in the permanent list of voters, the ERB shall place the application for registration previously disapproved in the corresponding book of voters and indicate in the application for registration the date of the order of inclusion and the court which issued the same.
Sec. 16. Petition for Exclusion of Voters from the List. - Any registered voter, representative of a political party or the EO, may file with the court a sworn petition for the exclusion of a voter from the permanent list of voters giving the name, address and the precinct of the challenged voter at any time but not later than August 31, 2016 (Wednesday). The petition shall be accompanied by proof of notice to the ERB and to the challenged voter and shall be decided within ten (10) days from its filing.
If the decision is for the exclusion of the voter’s name from the list, the ERB shall upon receipt of the final decision remove the voter’s registration record from the corresponding book of voters, enter the order of exclusion therein and place the record in the inactive file.
Sec. 17. Implementation of court inclusion/exclusion order. - The ERB shall implement Court Inclusion/Exclusion Orders that will become final and executory not later than September 30, 2016 (Friday). Otherwise, the same shall be referred to the Law Department.
The EO shall request from the ITD through EBAD the issuance of the access code to effect the inclusion/exclusion of the registration records of the concerned voters in the database.
Sec. 18. Abatement of double/multiple registration records - All registration records found to be double/multiple based in the Automated Fingerprint Identification System (AFIS) results, shall be abated pursuant to the policy adopted in Resolution No. 9888 dated July 28, 2014.
Sec. 19. Deactivation and Cancellation of Registration Records. - The deactivation of registration records provided in Resolution No. 9863, except on the ground of failure to vote twice, and cancellation of registration records in Section 36 of Resolution No. 9853 shall be applicable.
Sec. 20. ERB Certification of the Lists of Voters. - The ERB shall post notice of its meeting for the Certification of the Lists of Voters, which shall be conducted at least five (5) days prior to the scheduled posting in the bulletin boards of the OEO and the city/municipal hall.
Sec. 21. Posting of the certified and final list of voters. - The ERB shall post the certified and final list of voters (KK and Barangay) in the bulletin board of the OEO not later than September 16, 2016 (Friday).
Sec. 22. Role of the Regional Election Directors (REDs) and Assistant Regional Election Directors (AREDs) and Provincial Election Supervisors (PESs). - The REDs, AREDs and PESs shall monitor the conduct of registration, ensure timely compliance of the EOs submission of all the required reports and shall be held directly responsible and accountable for non-compliance within the period herein provided.
Sec. 23. Applicability of other resolutions of the Commission. - Pertinent provisions of Resolutions No. 9853 and No. 9863; and other Resolutions of the Commission pertaining to registration insofar as applicable and not inconsistent herewith shall apply.
Sec. 24. Effectivity. - This Resolution shall take effect seven (7) days after its publication in two (2) newspapers of general circulation in the Philippines. The Education and Information Department is hereby directed to cause the widest dissemination of this Resolution and its publication.
Let the Election and Barangay Affairs Department and Information Technology Department implement this Resolution.
